Term and TerminationThis Agreement shall remain in effect until terminated by you or GameGlobe Localization.
GameGlobe Localization may, at its sole discretion, at any time and for any reason or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from GameGlobe Localization, if you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the website and all copies thereof from your computer.
Upon termination of this Agreement, you must cease all use of the website and remove all copies of it from your computer. Termination of this Agreement shall not limit any rights or remedies GameGlobe Localization may have at law or in equity in the event of your breach (during the term of this Agreement) of any of your obligations under this Agreement.

To the maximum extent permitted by applicable law, GameGlobe Localization or its suppliers shall in no event be liable for any special, incidental, indirect or consequential damages (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, injury, loss of privacy arising out of or in any way connected with the use or inability to use the website, third-party software and/or hardware used with the website, or otherwise connected with any provision of this Agreement), even if GameGlobe Localization or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Severability If any provision of this Agreement is held to be invalid or unenforceable, that provision will be modified and interpreted to achieve the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will remain in full force and effect.
This Agreement, together with the Privacy Policy and any other legal notices published by GameGlobe Localization on the Services, constitutes the entire agreement between you and GameGlobe Localization with respect to the Services. If any provision of this Agreement is found to be invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the other provisions of this Agreement, which shall remain in full force and effect. No waiver of any provision of this Agreement shall be deemed a further or continuing waiver of such provision or any other provision, and GameGlobe Localization’s failure to exercise any right or provision under this Agreement shall not be deemed a waiver of such right or provision. YOU AND GameGlobe Localization AGREE that any legal action arising out of or relating to the Services must be commenced within one (1) year after the cause of action arises. Otherwise, such legal action will be permanently barred.
Waiver of RightsExcept as provided in this Agreement, the failure to exercise a right or perform an obligation under this Agreement shall not affect the ability of a party to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach shall not constitute a waiver of any subsequent breach.
The failure or delay by either party in exercising any right or power under this Agreement shall not constitute a waiver of such right or power. Also, no single or partial exercise of any right or power under this Agreement excludes the further exercise of that or any other right granted by this Agreement. In the event of a conflict between this Agreement and any applicable purchase terms or other terms, the terms of this Agreement shall prevail.
Changes to this Agreement GameGlobe Localization reserves the right, at its sole discretion, to change or replace this Agreement at any time. If the change is material, we will provide notice at least 30 days prior to the new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our website after any changes become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorised to use GameGlobe Localization.
Entire AgreementThis Agreement constitutes the entire agreement between you and GameGlobe Localization regarding your use of the website and supersedes all prior and contemporaneous written or oral agreements between you and GameGlobe Localization. You may be subject to additional terms and conditions that apply when you use or purchase other GameGlobe Localization services, which GameGlobe Localization will notify you of during such use or purchase.
Updates to our terms We may change our Services and policies, and we may need to make changes to these Terms to accurately reflect our Services and policies. Unless otherwise required by law, we will notify you (e.g., through our Service) before making changes to these Terms and give you an opportunity to review them before they take effect. Intellectual PropertyThe website and all of its content, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and their design, selection and arrangement) are the property of GameGlobe Localization, its licensors or other providers of such material and are protected by Ukrainian and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights. The materials may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without the prior written consent of GameGlobe Localization, except as expressly provided in these Terms and Conditions. Any unauthorised use of the materials is prohibited.
Arbitration AgreementThis section applies to any disputes, EXCEPT FOR DISPUTES RELATING TO CLAIMS FOR INJUNCTIVE OR EQUITABLE RELIEF RELATING TO THE PERFORMANCE OR VALIDITY OF YOUR OR GameGlobe Localization’S PERFORMANCE. The term ‘dispute’ means any dispute, claim or other controversy between you and GameGlobe Localization regarding the Services or this agreement, whether it relates to contract, warranty, tort, statute, regulation, ordinance or any other legal or equitable basis. The term ‘dispute’ shall have the broadest possible meaning permitted by law.
Notice of Dispute In the event of a dispute, you or GameGlobe Localization must send the other party a Notice of Dispute, which is a written statement containing the name, address and contact information of the party sending it, the facts giving rise to the dispute, and the relief sought. You must send any Notice of Dispute by email to: pr@gameglobe-localisation.com. GameGlobe Localization will send you a Notice of Dispute by post to your address, if we have it, or to your email address. You and GameGlobe Localization will attempt to resolve any dispute through informal negotiations within sixty (60) days of the date the Notice of Dispute is sent. After sixty (60) days, you or GameGlobe Localization may commence arbitration.
Binding ArbitrationIf you and GameGlobe Localization do not resolve any dispute through informal negotiations, any other attempts to resolve the dispute will be conducted exclusively through binding arbitration as described in this section. You waive your right to litigate (or participate as a party or class member) in any dispute in court before a judge or jury. The dispute shall be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Either party may apply to any court of competent jurisdiction for a temporary or preliminary injunction if necessary to protect the rights or property of the party pending the completion of arbitration. All legal, accounting and other costs, fees and expenses incurred by the prevailing party shall be borne by the losing party.
Submissions and ConfidentialityIn the event that you submit or publish any ideas, creative suggestions, designs, photographs, information, advertisements, data or proposals, including ideas for new or improved products, services, features, technologies or promotions, you expressly agree that such submissions shall automatically be treated as non-confidential and non-proprietary and shall become the sole property of GameGlobe Localization without any compensation or remuneration to you. GameGlobe Localization and its affiliates shall have no obligation with respect to such materials or submissions and may use the ideas contained in such materials or submissions for any purpose in any media in perpetuity, including, but not limited to, developing, manufacturing and marketing products and services using such ideas.
Promotions GameGlobe Localization may from time to time hold contests, promotions, sweepstakes or other events (‘Promotions’) that require you to submit materials or information about yourself. Please note that all Promotions may be governed by separate rules, which may contain specific eligibility requirements, such as age and geographic location restrictions. You are responsible for reviewing all Promotion rules to determine your eligibility to participate. If you participate in any Promotion, you agree to comply with and abide by all Promotion rules.

Typographical Errors In the event that a product and/or service is listed at an incorrect price or with incorrect information due to a typographical error, we have the right to refuse or cancel any orders placed for a product and/or service listed at an incorrect price. We have the right to refuse or cancel any such order, regardless of whether the order has been confirmed and whether the amount has been debited from your credit card. If your credit card has already been debited for the purchase and your order is cancelled, we will immediately refund the amount debited to your credit card account or other payment account.
MiscellaneousIf for any reason a court of competent jurisdiction finds any provision or portion of these Terms and Conditions to be invalid, the remainder of these Terms and Conditions shall remain in full force and effect. Any waiver of any provision of these Terms and Conditions shall be effective only if made in writing and signed by an authorised representative of GameGlobe Localization. GameGlobe Localization shall be entitled to injunctive relief or other equitable relief (without the obligation to post a bond or surety) in the event of any breach or threatened breach by you. GameGlobe Localization operates and controls the GameGlobe Localization Service from its offices in Ukraine. The Service is not intended for distribution or use by any person or organisation in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Accordingly, individuals who choose to access the GameGlobe Localization Service from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. These Terms and Conditions (which include and incorporate the GameGlobe Localization Privacy Policy) contain the entire understanding and supersede all prior agreements between you and GameGlobe Localization with respect to its subject matter and may not be altered or modified by you.
